1. Acceptance of Terms

By accessing and using Socialart.ai ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Socialart.ai provides AI-powered image generation and editing services. Our platform allows users to create, modify, and enhance images using advanced artificial intelligence technology and natural language processing.

3. User Accounts

To access certain features of our service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the service to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory
• Create images that violate copyright, trademark, or other intellectual property rights
• Generate content that is sexually explicit, violent, or promotes hate speech
• Upload or create content involving minors
• Create, generate, or manipulate any sexual content involving minors or individuals under the age of 18
• Attempt to reverse engineer, hack, or compromise our systems
• Use the service for commercial purposes without proper licensing
• Generate content that impersonates real individuals without consent

5. Uploaded Content and Consent

By uploading any image to Socialart.ai, you represent and warrant that:

• You are the rightful owner of the image or have obtained all necessary rights and permissions to use it
• You have the legal authority to grant us the license to process the image
• The image does not infringe on any third party's intellectual property rights, privacy rights, or other legal rights

Consent Requirements for Images of Others: It is strictly prohibited to upload images of other individuals to create, modify, or generate adult, NSFW (Not Safe For Work), sexually explicit, or intimate content without their explicit, informed, and documented consent. This includes but is not limited to:

• Creating deepfakes or manipulated images of a sexual nature
• Removing clothing or adding nudity to images of real people
• Generating intimate or compromising imagery of identifiable individuals
• Any modification that sexualizes or depicts someone in an adult context without their knowledge and consent

Violation of these consent requirements may result in immediate account termination and may be reported to law enforcement authorities. You acknowledge that creating non-consensual intimate imagery may constitute a criminal offense in many jurisdictions.

6. Intellectual Property Rights

Your Content: You retain ownership of images you upload. By using our service, you grant us a limited license to process your content to provide the service.

Generated Content: You own the images generated by our AI, subject to these terms and applicable law. However, you are responsible for ensuring your use complies with all applicable laws and rights of third parties.

Our Platform: Socialart.ai and its technology remain our property, protected by intellectual property laws.

7. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which governs how we collect, use, and protect your information. By using our service, you consent to the collection and use of information as outlined in our Privacy Policy.

8. Content Monitoring and Safety

To ensure the safety and legality of content on our platform, Socialart.ai employs automated content monitoring systems. By using our service, you acknowledge and agree to the following:

• Automated Scanning: All uploaded and generated content is automatically scanned using AI-based detection systems to identify potentially illegal material, including but not limited to Child Sexual Abuse Material (CSAM).
• CSAM Detection: We maintain dedicated systems specifically designed to detect CSAM. Any content flagged by these systems is reviewed and, if confirmed, immediately removed from our platform.
• Mandatory Reporting: In accordance with applicable laws, we are obligated to report any identified CSAM to the relevant authorities, including the National Center for Missing & Exploited Children (NCMEC) and local law enforcement agencies. We will fully cooperate with any resulting investigations.
• Data Preservation: When illegal content is detected, we may be required to preserve related account data, metadata, IP addresses, and other relevant information for law enforcement purposes, even after account termination.
• Content Safety Policy: Before uploading or generating media content, all users must accept our Content Safety Policy. This is a one-time confirmation acknowledging that you understand our monitoring practices and zero-tolerance policy for illegal content.

Our monitoring systems are designed to protect vulnerable individuals and ensure compliance with international laws regarding child exploitation. We continuously improve these systems to maintain the highest safety standards.

9. Service Availability

We strive to maintain high service availability, but we do not guarantee uninterrupted access. We may suspend or terminate service for maintenance, security reasons, or other operational needs.

10. Limitation of Liability

To the maximum extent permitted by law, Socialart.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of your use of the service.

11. Disclaimers

The service is provided "as is" without warranties of any kind. We do not warrant that the service will be error-free, secure, or meet your expectations. AI-generated content may not always be accurate or appropriate.

12. Account Termination and Enforcement

We reserve the right to terminate or suspend your account and access to the service at our sole discretion, including for violation of these terms. You may also terminate your account at any time.

Immediate Termination for Prohibited Content: Any attempt to create, generate, or manipulate sexual content involving minors will result in immediate account termination without prior notice. We maintain a zero-tolerance policy for such content and will report violations to appropriate law enforcement authorities.

No Refunds for Violations: In cases of account termination due to violations of these terms, particularly those involving prohibited content or minors:

• All active subscriptions will be immediately cancelled
• No refunds will be provided for unused subscription time or remaining credits
• All account benefits and services will be permanently revoked
• You will not be eligible to create a new account on our platform

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes. Continued use of the service after changes constitutes acceptance of the new terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute arising from these terms will be submitted to the competent court of the District Court Midden-Nederland (Rechtbank Midden-Nederland), the Netherlands, unless mandatory consumer law provides otherwise.

15. AI Influencer Marketplace

The marketplace sells AI-generated influencer models ("models"). Each model is sold once: on purchase it is taken off sale and its photos, video and Character are delivered to your account immediately. There is no cooling-off period: by completing a purchase you expressly consent to this immediate delivery of digital content and acknowledge that you thereby waive the 14-day right of withdrawal. A sale is final and cannot be returned or refunded; only if a model turns out to have been sold to someone else before your payment was processed is your payment refunded in full.

We have generated and tested every model and its Character with Google's Nano Banana 2.1 image model, and they work best with it. Other model providers (image and video models of third parties) apply their own content rules and may refuse, alter or filter photos of a model at any time. We do not control those providers and are not responsible for their behaviour, for how they handle the delivered photos, or for the results they produce; a provider refusing a model is not a defect of the model.

You receive an exclusive, perpetual right to use the delivered photos, video and Character for your own content: the model is sold once and we will never sell or license it to anyone else. The models are fictional AI-generated persons; you may not present them as real people, and all other rules in these terms, including Acceptable Use, apply to content you create with them. A Character delivered with a model stays as delivered and cannot be changed or deleted; its original photos can be downloaded at any time.
